ZONEIT UNIVERSAL TERMS OF SERVICE AGREEMENT​

PLEASE READ THIS UNIVERSAL TERMS OF SERVICE AGREEMENT CAREFULLY, AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS AND REMEDIES.

1. OVERVIEW​

This Universal Terms of Service Agreement (this "Agreement") is entered into by and between Zoneit ("Zoneit," "we," "us," or "our") and you ("you," "your," "User," or "customer") and is made effective as of the date of your use of our website or the date of electronic acceptance. This Agreement sets forth the general terms and conditions of your use of the Zoneit website and the products and services purchased or accessed through our site (individually and collectively, the "Services").

2. SERVICES DESCRIPTION​

Zoneit provides managed cloud hosting services optimized for WordPress websites, including but not limited to:

  • WordPress hosting services with dedicated resources

  • WooCommerce hosting services

  • Multiple site management capabilities

  • Headless WordPress hosting

  • Database management and scaling

  • Automated backup services

  • Email services

  • Domain management services

  • AI-powered support system

3. ACCOUNT ELIGIBILITY AND REGISTRATION​

3.1 By using our Services, you represent and warrant that:

  • You are at least 18 years of age

  • You are able to form legally binding contracts under applicable law

  • You are not barred from receiving services under applicable laws

  • All information you provide is accurate and complete

3.2 Account Security:

  • You are responsible for maintaining the security of your account credentials

  • You must notify us immediately of any unauthorized access

  • You are solely responsible for all activities that occur under your account

4. ACCEPTABLE USE POLICY​

4.1 Prohibited Uses:

You agree not to use the Services for:

  • Any unlawful purpose

  • Transmission of malware or harmful code

  • Unauthorized access to other systems

  • Sending unsolicited commercial communications (spam)

  • Activities that may disrupt our services or other users

4.2 Resource Usage:

  • You agree to use system resources in accordance with allocated limits

  • Resources are provided through dedicated containers

  • Excessive resource usage may result in service modification or suspension

5. CONTENT AND DATA​

5.1 Your Content:

  • You retain all rights to content you upload to our services

  • You grant us necessary licenses to host and deliver your content

  • You are responsible for backing up your content

5.2 Privacy and Data Protection:

  • We process data in accordance with our Privacy Policy

  • We implement industry-standard security measures including Kubernetes-based architecture

  • All data is stored in secure facilities

  • We maintain disaster recovery procedures

6. SERVICE LEVEL AGREEMENT​

6.1 Uptime Guarantee:

  • We strive to maintain 99.9% uptime for all services

  • Exclusions apply for scheduled maintenance

  • Service credits may be issued for verified downtime

6.2 Support:

  • AI-powered support available 24/7

  • Human support team backup available

  • Response times vary based on issue severity

7. FEES AND PAYMENT​

7.1 Pricing and Payment:

  • Fees are due at time of purchase

  • All fees are non-refundable unless otherwise specified

  • We accept major credit cards and other specified payment methods

7.2 Auto-Renewal:

  • Services auto-renew unless cancelled

  • You may opt-out of auto-renewal through your account

  • Renewal rates may differ from initial purchase rates

8. TERMINATION​

8.1 Termination Rights:

  • Either party may terminate with 30 days notice

  • We may suspend services immediately for Agreement violations

  • You remain responsible for fees incurred through termination

8.2 Effects of Termination:

  • Upon termination, you must cease using all Services

  • You have 30 days to export your data

  • We may delete your data after 30 days

9. LIMITATION OF LIABILITY​

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our liability is limited to amounts paid for Services

  • We are not liable for indirect or consequential damages

  • Total aggregate liability shall not exceed the amount paid for Services in the previous 12 months

10. WARRANTY DISCLAIMER​

THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. INDEMNIFICATION​

You agree to indemnify and hold harmless Zoneit, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of this Agreement.

12. MODIFICATIONS TO AGREEMENT​

We reserve the right to modify this Agreement at any time. Changes become effective upon posting to our website. Continued use of Services constitutes acceptance of modifications.

13. GOVERNING LAW​

This Agreement shall be governed by the laws of Victoria, Australia, without regard to its conflict of law provisions.
